This notice explains how we collect, use and protect your personal information when you use heareka.com and when you take part in the Heareka™ Outcome Study. Please read it alongside our Cookie Policy.
Who we are
The data controller is Heareka Labs Ltd (Company No. 15769416), registered in England and Wales, registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. Heareka is a trading style of Heareka Labs Ltd. Clinical study appointments are delivered through BestHear at our Swansea and Talbot Green clinics. What information we collect
- Details you give us through the eligibility check and contact: your name, email address, phone number, town or city, country, and the answers you provide.
- Information about your hearing and hearing-aid history that you share when checking your eligibility. This is health information and is treated as special category data (see below).
- Consent records, including the consent choices and the typed signature you provide on our consent form.
- If you take part in the study: clinical and audiological measurements taken at your appointment, and your answers to the study questionnaires (GHABP, SSQ-12, COSI and the CASE outcome measure).
- Only if you give separate, optional consent: photographs, video or written testimonials.
- Technical information collected automatically, such as your IP address and basic device or browser information, and limited cookie data (see our Cookie Policy).
Why we use it and our lawful basis
We use your information to check whether the study is a suitable fit for you, to contact you about your enquiry or appointment, to run and analyse the Heareka™ Outcome Study, to maintain a waiting list for future study phases, and to meet our legal and clinical record-keeping obligations.
Our lawful basis under UK GDPR for handling your general personal data is your consent (Article 6(1)(a)) when you submit an enquiry or join the waiting list, and our legitimate interests (Article 6(1)(f)) in administering the study and responding to you. For health information and other special category data, we rely on your explicit consent (Article 9(2)(a)) and, where applicable, scientific research purposes carried out with appropriate safeguards (Article 9(2)(j)). You can withdraw your consent at any time; doing so will not affect processing carried out before withdrawal.
Who we share it with
We do not sell your data. We share it only with service providers who help us run the study and the website, acting on our instructions as data processors. These include our customer-management platform (GoHighLevel), our website hosting (Hostinger) and our website infrastructure provider (Cloudflare). Some of these providers are based outside the UK; where data is transferred internationally we rely on appropriate safeguards such as the UK International Data Transfer Agreement or Standard Contractual Clauses. We may also disclose information where we are legally required to do so.
How long we keep it
We keep enquiry and waiting-list information for as long as needed to respond to you and to manage the study, and then delete it when it is no longer required. Study research records and clinical data are retained in line with research governance and professional record-keeping requirements. If you ask us to delete your data, we will do so unless we are required to keep it by law or for the integrity of the research record.
Your rights
Under UK data protection law you have the right to access your data, to have it corrected or erased, to restrict or object to how we use it, to data portability, and to withdraw consent at any time. To exercise any of these rights, email hello@heareka.com. You also have the right to complain to the Information Commissioner’s Office (ICO) at ico.org.uk, though we would appreciate the chance to put things right first.
Changes to this notice
We may update this notice from time to time. Any changes will be posted on this page with a revised date.
